NYTEST Proposed End Date

TO: All NYMA INSPECTION STATIONS

FROM: NYS DEPT. OF MOTOR VEHICLES

SUBJECT: NYTEST INSPECTION PROGRAM PROPOSED END DATE

The NYTEST emissions inspection has been an important part of the New York State emissions inspection program since 1998. This emissions inspection continues to test vehicles 1995 and older and vehicles over 8,500 lbs -- vehicles most likely to pollute. The NYTEST inspection program remains a critical component of meeting New York State’s responsibilities under the Clean Air Act and will remain in effect until December 31, 2010.

The NYS Department of Environmental Conservation has submitted a revised State Implementation Plan (SIP) to EPA, with the proposal to end the NYTEST program on December 31, 2010. If this plan is approved, the NYTEST Inspection program will end on that date. If it is not approved, the program could be extended. DMV will keep you informed of the progress of the revised SIP and will announce the actual program end date when it is finalized. We want you to have this information now, to help you make necessary business decisions.

In the meantime, it is essential that all NYTEST public stations and Shared Network Receiving Stations continue to maintain fully operational equipment in order to properly service the NYTEST population as required by regulation. Please be aware that participation in the Shared Network Program remains open to interested facilities. The NYTEST equipment vendors will offer a service contract lasting until the proposed end of NYTEST. We urge you to explore this option with your vendor to ensure that your equipment is in good working order. DMV and DEC will continue audits of the equipment and will require that the analyzers be capable of performing required inspections on subject vehicles.
