Subject: Effective Date of Inspection Regulations and NYVIP Equipment Requirements

 

 

Revisions to Part 79 of the Commissioner’s Regulations have been adopted and are effective as of May 5, 2005. These revisions require all 1996 and newer vehicles that are subject to an OBD II emissions test to be tested on the NYVIP equipment, and all public inspection stations must have the equipment operable as of that date.

 

Public Stations that do not have the NYVIP equipment installed and in use by May 5, 2005, will be prohibited from performing all inspections until the equipment is operable.

 

The NYVIP system has a much better message system than was possible with NYTEST, and DMV will be sending information to stations on a regular basis. When a message is sent to your NYVIP unit, a mailbox icon will appear at the top of the screen. From the Main Menu, select option #2, “View State Messages”. Messages may be viewed and printed. Stations should make sure that all inspectors are aware of new messages. 

 

DMV will also send the regulation revisions over the NYVIP system, allowing stations to print them immediately rather then wait for a mailed copy. DMV will not be mailing copies of regulations to NYVIP stations. The NYVIP Operators Manual was provided with a place to put the Inspection Regulations. Stations must print the regulations when they are received, keep them in the binder, and make them available to all inspectors.

 

Vehicles that require a dynamometer or idle test will still be tested and recorded using the NYTEST equipment. Diesel powered vehicles that require a Diesel Emissions test will continue to be inspected as they have been and those inspection records will still be kept on the VS-1074SD form. All other inspections will be performed and recorded by the NYVIP equipment, including Safety-only inspections of exempt vehicles and trailers. If a 1996 or newer vehicle which requires an OBD II test is tested on a NYTEST machine, it will fail the inspection.

Summary of Part 79 Commissioners Regulation Changes

 

The purpose of this revision is to implement the NYVIP program in the NYMA, in addition to outside the NYMA, and integrate it with the current Low Enhanced and downstate High Enhanced emissions (idle & dynamometer) programs. The NYVIP program requires OBD II emissions testing for vehicles that are model year 1996 and newer, non-diesel and non-electric powered, under 8501 lbs. MGW, registered statewide, except for Custom or Homemade vehicles.

 

The following are highlights related to the OBDII inspection portion of the revision:

 

·        There are three types of emissions tests: High Enhanced (dynamometer and idle tests in the NYMA), Low Enhanced (Upstate), and OBD II (statewide).

·        There are two types of emissions stations: High Enhanced (NYMA) and Low Enhanced (Upstate). Either one may perform an OBD II Emissions inspection, on 1996 and newer qualifying vehicles, with the proper equipment.

·        After 5/5/05, all Safety, Low Enhanced and OBD II inspections must be performed in the NYVIP CVIS.

·        All inspection fees are now maximum value. A station may now charge up to, but not more than, the stated fee.

·        The OBD II inspection fee will be based on the location of the station, not the vehicle registration. The fee for an OBD II test in the NYMA is $37.  The fee in Upstate counties is $21.

 

There are also changes to several other sections to support changes to the emissions program.  These include:

 

79.1 (L) Clarifies that heavy vehicles are no longer inspected as “trucks”, but as “vehicles”, allowing Heavy Vehicle inspection of large motorhomes.

 

79.1 (u) Clarifies the name of the Air Bag light, so it’s not confused with any other indicator light.

 

79.20(c)(7)(i) Requires trailer stickers to have the plate number entered in the “Odometer” box on the sticker, so a sticker may only used with one trailer.

 

79.21(e) Fog lights – removes reference to a specific switch and now states only that they must be operated independently. It was found that some manufacturers use a special function of the headlight switch to operate fog lights.

 

79.21(g) Clarifies mirror requirements, by vehicle year.

 

79.24(g) Allows a Low Enhanced re-inspection to be performed at a High Enhanced station.

 

79.24(i) Clarifies that Homemade or Custom vehicles are only subject to the Gas Cap portion of the Emissions Control Device check. This section also includes OBD II.

 

 

This only a brief summary of the revisions, and there are other changes. Stations should review the revisions thoroughly when they are received.
