Non-Warranty Charges (Non-Returned / Damaged Components)

SGS Testcom offers a complete warranty on the NYVIP system for the duration of the Program Term to keep your equipment operational and your vehicle inspection service in business. Provided you take care of the equipment and abide by the terms and conditions set forth in the Station Participation Agreement (SPA) you will receive Break-Fix services without additional charges. If you fail to ship back defective component(s), or return component(s) for reasons that are not covered under Break-Fix services, you may be responsible for additional charges as indicated in the sections below. If you have any questions about the warranty coverage on your NYVIP unit or the non-warranty information below please contact the NYVIP Help Desk (866-469-8477).

NON-RETURNED COMPONENTS:

Section 35. USER RESPONSIBILITIES: User agrees to return any identified defective Customer Replaceable Component (CRC) as directed by SGS Testcom within 3 days of User.s receipt of the replacement CRC. In the event you fail to return a defective component within the required timeframe, SGS Testcom will invoice you for the replacement price of the component plus the shipping and handling costs for delivering the replacement component to the Station. Once a non-return invoice has been issued there will be no refunds for late returned component(s).

You later receive a call from SGS Testcom confirming the replacement unit resolved your problem and requesting that you return the original component if you have not already done so. You fail to return the malfunctioning unit to SGS Testcom in the required timeframe. Within 2-3 weeks you will receive a non-return invoice in the amount of $578.41.

Section 38. MISUSE, ACCIDENT, LOSS NOT COVERED BY B/F SERVICES: Where B/F Services do not cover malfunctioning NYVIP Units or their Components due to Loss, SGS Testcom will sell replacement Components to User.

AVOID ADDITIONAL CHARGES: If a component of your NYVIP equipment becomes non-operational due to loss, damage, modification or other non-covered circumstances (SPA section 38), please contact the NYVIP Help Desk (866-469-8477) to purchase an authorized replacement component directly from SGS Testcom. Please avoid using Break-Fix services in these cases as it will result in additional cost to the Station. SGS Testcom offers expedited shipping options at an additional cost, for those who need guaranteed next day delivery, or Saturday delivery.

If you return a CRC component to SGS Testcom that has been damaged due to abuse or negligence of the station, SGS Testcom will invoice you for the replacement price of the component plus shipping and handling for the replacement component to the Station, and the return shipping and handling of the damaged component back to SGS Testcom.

Per the SPA, you have the right to request your original damaged item back. However, you must indicate this in the space provided on the damaged invoice remittance stub and include payment for the additional return shipping along with your payment for the damage invoice amount due. Once all amounts have been paid, SGS Testcom will return the damaged component to you. Damaged components may be visibly marked as such and are no longer covered under Break-Fix services, and cannot be put back into service with any NYVIP units, as doing so may result in further charges to you.

Example Damaged:
You have an HHP 4600 barcode scanner that was on the floor of your station sitting in a pool of liquid, and now the unit will not function, so you contact the NYVIP Help Desk to report a problem with your barcode scanner. The Help Desk inquires about the overall condition of the unit and if the unit has been subject to any damage, to which you reply it has not. You receive a replacement unit from SGS Testcom under Break-Fix services, and return the original unit in the box using the prepaid return label. Upon receipt, SGS Testcom evaluates the returned unit and sees that there is liquid inside the barcode scanner housing and lens. SGS Testcom takes photographs of the unit and it.s condition and updates the service call record with this information. Following the evaluation of the component SGS Testcom issues you a damaged component invoice in the amount of $604.91, and sends the invoice and supporting photographs/evaluation to you.
